ASP Independent Contractor Policy
The following is the independent contractor policy of ASP concerning work hours, for individuals in Sales and Human Resources. This has been developed for informational purposes to help provide for orderly and efficient operations and to achieve the purpose and goals of ASP.
This policy sets forth information that should be used as a guide, and should not be mistaken as an employment contract. Changes in federal or state laws, in business conditions, in administering policies or other such factors may require management to change portions of this policy without notice. While the policy may be updated as needed, please contact your supervisor or department head if questions arise.
Your association is at-will, and can be terminated by you or ASP, with or without cause, and with or without notice, at any time.
Your primary duty (more than 50% of your time) will be to conduct business outside of ASP’s regular places of business (which may include your own home). This shall include, but not be limited to, tasks such as distributing PAL® cards, flyers, brochures, bulletins, and overseeing drop boxes and tear off sheets in an effort to facilitate sales and/or recruitment. To qualify for this option, you must spend more than 50% of your time conducting such work as determined on a weekly basis. You will not be subject to quotas, and you will be compensated based on a commission structure.
Your association shall be as an independent contractor. This option shall not render you an employee, partner or joint venture with ASP for any purpose. You are and will remain an independent contractor in your relationship to ASP. ASP shall not be responsible for withholding federal or state income taxes, social security or Medicare from your compensation; and you shall have no claim against ASP for vacation pay, sick leave, retirement benefits, social security, worker’s compensation, health or disability benefits, unemployment insurance benefits, or employee benefits of any kind. Those hired as an independent contractor shall be exempt from the Fair Labor Standards Act minimum wage and overtime requirements.
ASP shall not reimburse independent contractor for any expenses that are incurred in connection with his/her duties with ASP.
Submission of invalid sales and/or hires is immediate grounds for termination of association.

All of the content on this site is the property of ASP or its clients and is protected by international copyright laws. The arrangement of the content on this site is the exclusive property of ASP and is also protected by U.S. and international copyright laws. All of the software used on or in support of this site and the processes described on this site are the property of ASP. The site may be used by visitors to learn about ASP, by associates to perform their assigned work functions, and by clients to access information regarding their own programs, to the extent specifically authorized by ASP. Any other use of the content on this site is strictly prohibited.
ASP’s name, domain names and all ASP logos are trademarks of ASP. The ASP trademarks may not be used in connection with any product or service that is not an ASP product or service, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ASP.
ADDITIONAL INFORMATION
Paychecks are issued on a weekly basis and mailed directly to your home.
No checks will be issued for less than $20. All amounts less than this will be accrued until $20 is reached or associate is no longer affiliated with ASP. Independent Contractor agrees not to disclose or threaten to disclose any information which concerns ASP’s products and competitive business position to any person or use such information in any way to compete with or to act in any way adverse to ASP while affiliated or acting on behalf of ASP or at anytime thereafter.
Independent Contractor agrees, both during the period of affiliation and thereafter, that Independent Contractor shall not use (except for work performed on behalf of ASP Inc.), disclose or permit any person to obtain any trade secrets or confidential information of ASP (whether or not such trade secrets or confidential information is in written or tangible form), except as specifically authorized in writing by ASP.
Please be advised that no associate of ASP is allowed to insert any reference to the BBB (Better Business Bureau) into any ad, i.e., internet, newspaper, etc. While we are in good standing with the BBB and are members of the BBB online reliability program, it is against their policy for our company to make any reference to them in any form of advertisement. Please be advised that any reference to the BBB in any ad will be grounds for termination of your contract with ASP.
ASP does not require any associate to enroll in any of its health care savings plans in order to work for the company. ASP’s products are made available to associates at a special reduced associate rate. Any associate can continue or discontinue his/her health care savings plan regardless of their continued affiliation with ASP.
